Alle prijzen zijn uitgedrukt in euro en exclusief btw.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Train IT Now B.V. behoudt zich het recht voor prijzen tussentijds te wijzigen. Prijswijzigingen worden minimaal 30 dagen van tevoren gecommuniceerd.<\/p><h3 style=\"font-size:18px;font-weight:600;margin:22px 0 8px\">Betaling<\/h3><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">De totale verschuldigde prijs, vermeerderd met btw, dient binnen 30 dagen na ontvangst van de factuur door de klant te zijn voldaan. Deze betalingstermijn is een fatale termijn. Bij niet tijdige betaling is de klant direct in verzuim en wordt wettelijke rente in rekening gebracht.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Indien Train IT Now B.V. gerechtelijke en buitengerechtelijke incassokosten maakt, komen deze volledig voor rekening van de klant.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Betaling dient altijd uiterlijk voor aanvang van de cursus door Train IT Now ontvangen te zijn. Bij gebreke daarvan kan Train IT Now de cursist de toegang tot de cursus ontzeggen. Voor inschrijvingen minder dan 14 dagen voor de cursusdatum dient de betaling direct bij inschrijving te geschieden.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Indien de training door een derde partij wordt uitgeleverd, gelden de betalingsvoorwaarden van de derde partij.<\/p><\/div><div style=\"margin:0 0 44px\"><h2 style=\"font-size:26px;margin:0 0 16px;padding-bottom:12px;border-bottom:1px solid var(--line)\">4. Annulering en verplaatsing<\/h2><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Klant mag desgewenst een vervanger voor de ingeschreven cursist sturen.<\/p><h3 style=\"font-size:18px;font-weight:600;margin:22px 0 8px\">Annulering door de klant<\/h3><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Annulering van klassikale of e-learning trainingen dient schriftelijk te gebeuren. Voor klassikale trainingen gelden de volgende annuleringskosten:<\/p><ul style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:8px 0 16px;padding-left:22px\"><li>Meer dan 14 kalenderdagen voor de start: kosteloos.<\/li><li>Tussen 14 en 7 kalenderdagen voor de start: 50% van het trainingsbedrag.<\/li><li>Minder dan 7 kalenderdagen voor de start: 100% van het trainingsbedrag.<\/li><\/ul><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Voor e-learning trainingen geldt dat na toekenning van de toegangscode geen annulering meer mogelijk is.<\/p><h3 style=\"font-size:18px;font-weight:600;margin:22px 0 8px\">Verplaatsing door de klant<\/h3><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Verzoeken tot het verplaatsen van een klassikale training dienen minimaal 7 kalenderdagen voor de geplande start schriftelijk te worden ingediend. Indien een verzoek korter dan 7 kalenderdagen voor de start wordt ingediend, wordt 50% van de trainingskosten in rekening gebracht. Voor e-learning trainingen is verplaatsing niet mogelijk.<\/p><h3 style=\"font-size:18px;font-weight:600;margin:22px 0 8px\">Annulering door Train IT Now B.V.<\/h3><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Train IT Now B.V. behoudt zich het recht voor een training te annuleren of te verplaatsen bij onvoldoende deelnemers, overmacht of andere dringende omstandigheden. Examenvoorwaarden<\/h2><ul style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:8px 0 16px;padding-left:22px\"><li>Examens worden afgelegd in een Train IT Now Testing Center of bij een derde partij.<\/li><li>Aanmeldingen moeten minimaal 5 werkdagen voor de examendatum worden ingediend.<\/li><li>Niet verschijnen op het examen resulteert in volledige kosten.<\/li><li>Examens kunnen eenmaal kosteloos worden gewijzigd, mits minimaal 2 werkdagen voor de examendatum.<\/li><li>Examenstrippenkaarten en examenvouchers zijn niet overdraagbaar en maximaal 1 jaar geldig.<\/li><\/ul><\/div><div style=\"margin:0 0 44px\"><h2 style=\"font-size:26px;margin:0 0 16px;padding-bottom:12px;border-bottom:1px solid var(--line)\">9. Overmacht<\/h2><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Onder overmacht wordt verstaan alle omstandigheden die buiten de controle van Train IT Now B.V. vallen en die de nakoming van de overeenkomst geheel of gedeeltelijk verhinderen, waaronder in ieder geval:<\/p><ul style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:8px 0 16px;padding-left:22px\"><li>Natuurrampen zoals aardbevingen, overstromingen en stormen.<\/li><li>Brand, explosies of andere calamiteiten die de dienstverlening onmogelijk maken.<\/li><li>Oorlog, terrorisme, opstanden of andere gewelddadige conflicten.<\/li><li>Overheidsmaatregelen, zoals invoer- of uitvoerverboden, sancties of quarantainemaatregelen.<\/li><li>Stakingen, bedrijfsbezettingen of andere arbeidsconflicten, zowel binnen als buiten Train IT Now B.V.<\/li><li>Storingen in nutsvoorzieningen, telecommunicatie of internetverbindingen die buiten de invloedssfeer van Train IT Now B.V. liggen.<\/li><li>Epidemieen, pandemieen en andere gezondheidscrisissen die door overheidsinstanties als zodanig zijn erkend.<\/li><\/ul><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">In geval van overmacht heeft Train IT Now B.V. het recht de uitvoering van de overeenkomst op te schorten of te annuleren, zonder dat de klant recht heeft op enige vorm van schadevergoeding.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Indien de overmachtssituatie langer dan 30 dagen voortduurt, hebben beide partijen het recht om de overeenkomst schriftelijk te ontbinden zonder verplichting tot schadevergoeding of restitutie, tenzij anders overeengekomen.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Bij ziekte van een trainer spant Train IT Now B.V. zich in om een vervangende trainer te regelen. Is dit niet mogelijk, dan wordt in overleg met de klant een alternatieve datum voorgesteld of een passende oplossing gezocht.<\/p><\/div><div style=\"margin:0 0 44px\"><h2 style=\"font-size:26px;margin:0 0 16px;padding-bottom:12px;border-bottom:1px solid var(--line)\">10. Schema's en tijdschema's<\/h2><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Train IT Now zal al het redelijke in het werk stellen om cursussen doorgang te laten vinden, dan wel de te verlenen diensten uit te voeren. Train IT Now is niet aansprakelijk indien cursussen of diensten geen doorgang vinden om redenen die buiten haar invloedssfeer liggen. Als een trainer door ziekte, einde dienstverband of een andere reden niet meer beschikbaar is, stelt Train IT Now al het redelijke in het werk om de cursus of dienst alsnog, eventueel op een later tijdstip, doorgang te laten vinden. Blijkt dit niet mogelijk, dan worden reeds gedane betalingen aan de klant gerestitueerd.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Train IT Now behoudt zich het recht voor zonder opgaaf van redenen wijzigingen in cursusschema's of cursustijden aan te brengen en bij onvoldoende belangstelling cursussen te annuleren. De klant wordt van een annulering uiterlijk twee weken voor aanvang schriftelijk in kennis gesteld. Reeds betaalde cursuskosten worden bij annulering door Train IT Now direct gerestitueerd.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Tenzij uitdrukkelijk anders overeengekomen, zijn de cursustijden van Train IT Now dagelijks van 09.00 tot 12.30 uur en van 13.30 tot 16.30 uur, van maandag tot en met vrijdag, uitgezonderd algemeen erkende feestdagen. Valt er een officiele feestdag in een cursusweek, dan worden de cursustijden aangepast. Een- of tweeweekse cursussen eindigen op vrijdag om 13.00 uur.<\/p><\/div><div style=\"margin:0 0 44px\"><h2 style=\"font-size:26px;margin:0 0 16px;padding-bottom:12px;border-bottom:1px solid var(--line)\">11. Non-concurrentie<\/h2><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Partijen mogen elkaars medewerkers niet in dienst nemen of laten werken zonder voorafgaande schriftelijke toestemming, gedurende en tot 1 jaar na de overeenkomst.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Bij overtreding geldt een boete van 2.000 euro per dag.<\/p><\/div><div style=\"margin:0 0 44px\"><h2 style=\"font-size:26px;margin:0 0 16px;padding-bottom:12px;border-bottom:1px solid var(--line)\">12. Toepasselijk recht<\/h2><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Op deze algemene voorwaarden en alle overeenkomsten met Train IT Now B.V. is Nederlands recht van toepassing.<\/p><p style=\"color:#3a3850;font-size:16px;line-height:1.7;max-width:74ch;margin:0 0 14px\">Geschillen worden voorgelegd aan de bevoegde rechter in Utrecht, tenzij partijen eerst trachten het geschil onderling op te lossen.
